The United States of America was founded with the idea of Checks and Balances in mind. It is one of the most important parts of our democracy, ensuring that no one person or group has the power to take control of the legislature. With the challenges everyone has faced this past year, California Governor Newsom has taken advantage of the issues to take more control for himself.
Without delay, Gavin Newsom declared a state of emergency at the beginning of the pandemic. Following this Governor Newsom released several orders regarding our economy and society, some even directly contradicting past laws. His intent, allegedly, was to prevent any more COVID-19 infections.
With how apparent it is that Newsom is abusing the powers of the Governor, the calls for a recall have only grown louder. The continuous rules and regulations Newsom has implemented such as keeping public schools closed have created more support for the recall campaign from both Republicans and Democrats.
Unfortunately, the 3rd District Court of Appeal without opposition announced Gavin did not abuse legal authority, revoking the prior Superior Court ruling that decided he went against state laws in his declarations.
As Republican Assemblyman James Gallagher and Kevin Kiley stated, “The issue now squarely presented for the high court is whether the separation of powers still exists in California.” The future of California and its separation of powers is at stake as Newsom faces a recall this November. If he is recalled Californians of all parties can take a sigh of relief as their future will be determined using legal and appropriate measures by a governor who (hopefully) respects the Constitution of our incredible state.
