Contract amendments lacking board approval, missing and poorly maintained paperwork, and excessive payments to consultants have all been identified as areas of concern. Moreover, the auditors accuse the management of obstructing their investigation, hindering the auditors&#8217; ability to carry out a comprehensive review.<\/p>\n<p>As a taxpayer-funded planning agency with a budget of over $1 billion, SANDAG plays a crucial role in making transportation and other long-term regional decisions. The findings of the audit expose the agency and its budget to significant risks, including unanticipated cost increases, potential collusion between staff and contractors, and the risk of losing federal grants due to noncompliance. These issues directly impact the residents of San Diego and their quality of life.<\/p>\n<p>The Democrat leadership at SANDAG has disputed many of the audit&#8217;s findings, raising further concerns about their commitment to transparency and accountability. Their reluctance to provide direct access to documents, citing confidentiality concerns, reveals a lack of cooperation and transparency. This obstructive behavior hampers the auditors&#8217; ability to perform their duties and raises suspicions about what might be hidden from public scrutiny.<\/p>\n<p>The audit report also sheds light on questionable practices regarding vendor contracts. Large contract amendments were made without proper board approval, indicating a lack of oversight and accountability. Additionally, the excessive use of consultants for tasks that could have been performed by in-house staff raises concerns about potential conflicts of interest and wasted resources. From left: Lesa Heebner, Sean Elo-Rivera, Nora Vargas, CEO Hasan Ikhrata and attorney John Kirk.<i>(Sandy Huffaker for inewsource)<\/i><\/figcaption><\/figure>\n<article id=\"post-67833\" class=\"post-67833 post type-post status-publish format-standard has-post-thumbnail hentry category-government category-latest-news tag-san-diego-county tag-sandag type-of-work-news entry\">\n<div class=\"entry-content\">\n<p>A new audit reviewing contracts at the\u00a0<a href=\"https:\/\/www.sandag.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">San Diego Association of Governments<\/a>\u00a0is again raising concerns about the regional planning agency\u2019s leadership, and its in-house watchdog team is accusing management of impeding its work.<\/p>\n<p>Internal auditors say SANDAG\u2019s process of awarding contracts is concerning enough that even after their monthslong review, they\u2019re conducting further investigation and will refer their findings to outside oversight agencies.<\/p>\n<div class=\"wp-block-group alignleft why-matters has-white-color has-primary-variation-background-color has-text-color has-background is-layout-flow\">\n<div class=\"wp-block-group__inner-container\">\n<h3 class=\"wp-block-heading\">Why this matters<\/h3>\n<p>With a $1 billion annual budget, the San Diego Association of Governments is a taxpayer-funded planning agency that helps make transportation and other long-term regional decisions.<\/p>\n<\/div>\n<\/div>\n<p>Officials did not specify which matters they will further investigate, nor did they say which agencies they believe should look into the audit further.<\/p>\n<p>The report released late Friday by SANDAG\u2019s\u00a0<a href=\"https:\/\/www.sandag.org\/about\/office-of-the-independent-performance-auditor\" target=\"_blank\" rel=\"noreferrer noopener\">Office of the Independent Performance Auditor<\/a>\u00a0flagged large contract amendments that lacked board approval, missing and poorly kept paperwork, and millions of dollars in consultant payments for work that auditors argued could have been done by in-house staff.<\/p>\n<p>Mary Khoshmashrab, who has headed the office since 2019, also noted that some members of management \u201cremained unwilling to provide direct access\u201d to certain documents over confidentiality concerns \u2014 a move that hindered the auditors\u2019 work, she said.<\/p>\n<p>SANDAG leaders disputed many of the audit\u2019s findings and believe they \u201cfully cooperated,\u201d according to the agency\u2019s written response. CEO Hasan Ikhrata also said that SANDAG has already improved policies that address some of the auditors\u2019 concerns.<\/p>\n<p>Ikhrata continued: \u201cManagement also wishes to establish that, even if it does not agree with portions of the audit or the way some elements are described, it is supportive and appreciative of many of the recommendations to the extent they provide opportunities for enhancements to SANDAG\u2019s business operations.\u201d<\/p>\n<p>Internal auditors said their findings open the agency and its more than $1 billion budget to serious potential risks: Among them are unanticipated cost increases, collusion between staff and contractors, and losing federal grants due to noncompliance.<\/p>\n<p>Like a previous audit that looked into the agency\u2019s contracts, the latest report again does not identify the vendors.<\/p>\n<p>Khoshmashrab said because of the obstacles her office faced during the audit, staff were unable to perform sufficient testing and opted against making statements regarding whether fraud existed.<\/p>\n<p>\u201cHowever, auditors can state that based on the testing that auditors were able to perform, auditors found no indication of intentional wrongdoing or fraud by staff,\u201d she wrote in her report.<\/p>\n<p>But they did raise concerns about some vendor practices. In one project involving SANDAG\u2019s toll operations systems, a contractor \u2014 a services firm identified as \u201cVendor AA\u201d \u2014 was awarded more money because another company it was overseeing \u2014 described as \u201cVendor EE\u201d \u2014 didn\u2019t do its job on time.<\/p>\n<p>Vendor EE was supposed to complete its work in 2019, but its task order has been extended by four years to 2023 \u201cdue to failure to perform.\u201d As a result, Vendor AA has seen eight cost changes increasing the value of its contract.<\/p>\n<p>Auditors warned that using consultants to perform project management duties created a possible conflict of interest: Vendor AA has a financial incentive, they said, to allow delays and recommend extensions.<\/p>\n<p>SANDAG staff had also failed to conduct regular performance evaluations of the work, which has yet to be completed.<\/p>\n<p>Among auditors\u2019 other findings:<\/p>\n<ul>\n<li>Forty-four of 122 task order changes exceeded $100,000 and did not receive specific board approval, which auditors found concerning despite being allowed under current policy.<\/li>\n<li>Seventeen of 201 transactions were inappropriately dated retroactively to authorize changes after a contract or task order had already expired.<\/li>\n<li>Approval documents such as cost estimates, records of negotiations and others were missing from 170 transactions.<\/li>\n<li>More than 100 consultant contracts totaling some $40 million were awarded for human resources and legal services,\u00a0which auditors flagged for \u201coverlap\u201d with internal staff\u2019s expected duties and qualifications.<\/li>\n<\/ul>\n<p>This audit follows others that have embroiled the agency in recent years. Khoshmashrab has also issued reports detailing improper severance payments and\u00a0<a href=\"https:\/\/inewsource.org\/2022\/04\/07\/sandag-taxpayer-funded-upscale-dining\/\" target=\"_blank\" rel=\"noreferrer noopener\">misuse of agency-issued credit cards<\/a>.<\/p>\n<p>Her office already\u00a0<a href=\"https:\/\/inewsource.org\/2022\/10\/14\/sandag-contracts-audit\/\" target=\"_blank\" rel=\"noreferrer noopener\">flagged vendor contracts<\/a>\u00a0in October, when auditors found SANDAG increased awarded amounts by tens of millions of dollars with little documentation and poor oversight.<\/p>\n<p>The agency\u2019s 10 vendors with the highest percentage changes were originally awarded nearly $48 million in work \u2014 and that total more than doubled over four years to almost $106 million.<\/p>\n<p>Auditors continued to flag the increases in the latest report, pointing out that one contractor hired for environmental and engineering services for the recent\u00a0<a href=\"https:\/\/www.masstransitmag.com\/rail\/infrastructure\/article\/21267569\/midcoast-corridor-program-delivered-with-a-projectfirst-mentality\" target=\"_blank\" rel=\"noreferrer noopener\">Blue Line trolley extension project<\/a>\u00a0was originally awarded $25 million, but the final contract amount had increased to more than $128 million \u2014 over 400% higher.<\/p>\n<p>Ikhrata said that amount was not excessive and instead \u201creflects the size and complexity\u201d of the project.<\/p>\n<p>He also defended the agency\u2019s use of consultants for human resources and legal services, saying auditors didn\u2019t fully consider \u201cthe operational needs of the agency\u201d and argued that it was outside of the scope of their report\u2019s objectives.<\/p>\n<figure maintained he had authority as head of SANDAG to make large increases to vendor contracts without board approval as long as the amount stayed within the total project budget.<\/p>\n<p>Khoshmashrab\u2019s office responded to Ikhrata\u2019s rebuttal, saying it still remained concerned about many of the findings \u2014 including that board rules allow Ikhrata, in theory, to make millions of dollars worth of contract increases while working with large project budgets without formally asking board leaders.<\/p>\n<p>She stressed that a project budget often covers several contracts awarded to various vendors, \u201cnot just one,\u201d and \u201cthis is why a project budget is approved for a high dollar value, not for the use of amending\/increasing a contract.\u201d<\/p>\n<p>Auditors also dismissed what Ikhrata called a \u201cdifficult and cumbersome\u201d process to retrieve SANDAG\u2019s large amount of paperwork.
