{"id":8502,"date":"2022-03-31T13:41:25","date_gmt":"2022-03-31T20:41:25","guid":{"rendered":"https:\/\/sandiegonewsdesk.com\/?p=8502"},"modified":"2022-03-31T13:41:25","modified_gmt":"2022-03-31T20:41:25","slug":"encinitas-illegally-rejects-housing-proposal-state-steps-in","status":"publish","type":"post","link":"https:\/\/sandiegonewsdesk.com\/?p=8502","title":{"rendered":"Encinitas Illegally Rejects Housing Proposal, State Steps in"},"content":{"rendered":"<p>Written by Vincent Cain<\/p>\n<p><span style=\"font-weight: 400;\">Encinitas has violated laws again by blocking the construction of more homes,<a href=\"https:\/\/voiceofsandiego.org\/2016\/03\/09\/years-of-defying-state-affordable-housing-law-gets-encinitas-sued-again\/\"> with their defense being that it would change the city&#8217;s character<\/a>, and now the state is getting involved.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Last week, the State Attorney General warned Encinitas about an illegal rejection of a housing project in November. <a href=\"https:\/\/encinitas.granicus.com\/MetaViewer.php?view_id=7&amp;clip_id=2589&amp;meta_id=131652\">The City Council rejected<\/a>\u00a0 Encinitas Boulevard Apartments, a\u00a0 277-unit housing project from developer R. Randy Goodson, 41 of which were for low-income residents.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/Letter%20to%20City%20of%20Encinitas%20March%2024%202022.pdf\">Rob Bonta, the State Attorney General, sent a letter<\/a> to Encinitas Mayor Catherine Blakespear, urging her to approve the project.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;If the city fails to do so, the Attorney General is prepared to take immediate steps to hold the city accountable,&#8221; Deputy Attorney General Matthew Struhar wrote on behalf of Bonta.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the Attorney General&#8217;s office, Encinitas&#8217; rejection of the proposal violated the Housing Accountability Act and the Density Bonus Law. The project met the required standards, but the city denied it anyway.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Randy Goodson has filed a lawsuit against the city, arguing that he had met the requirements to move forward. He now intends to submit a revised proposal, increasing the number of very low- and low-income housing by about 5% to 55 units.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The city has no choice but to accept the proposal because it has not met the necessary share of the regional housing needs for low-income households.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Encinitas has a history of attempting to sneak around laws relating to housing. For example, a couple of years ago, Gavin Newsom and the Attorney General warned Encinitas about its failure to complete its Housing Element, which is a plan that cities submit to the state that finds locations for housing production of all income levels.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Two years ago, <a href=\"https:\/\/voiceofsandiego.org\/2020\/12\/11\/encinitas-wants-to-exempt-itself-from-new-state-density-law\/\">Encinitas also tried to exempt itself from the state density bonus law<\/a>, incentivizing private developers to build low-income housing.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">California&#8217;s response is part of a more significant effort to ensure that all cities comply with housing laws amid California&#8217;s housing shortage and affordability crisis.\u00a0<\/span><\/p>\n<p>Photo Cred: ABC 10 News<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Written by Vincent Cain Encinitas has violated laws again by blocking the construction of more homes, with their defense being that it would change the city&#8217;s character, and now the state is getting involved.
