This hasty decision with no legitimate reason given will cause a systematic roll back of civil rights protections at the federal level and a cascade effect of encouraging race preferences in college admissions.<\/p>\n<p>As a result of a two-year investigation into\u00a0<a href=\"https:\/\/californiansforequalrights.us10.list-manage.com\/track\/click?u=b78c84756813bc7a3a38500a0&amp;id=91ac87fe03&amp;e=7b63eee6f1\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/californiansforequalrights.us10.list-manage.com\/track\/click?u%3Db78c84756813bc7a3a38500a0%26id%3D91ac87fe03%26e%3D7b63eee6f1&amp;source=gmail&amp;ust=1612557938142000&amp;usg=AFQjCNGcFhiwlw50gdpKZyFM0i5IgOH1xQ\">a 2016 civil rights complaint<\/a>\u00a0filed by the Asian American Coalition for Education,\u00a0<a href=\"https:\/\/californiansforequalrights.us10.list-manage.com\/track\/click?u=b78c84756813bc7a3a38500a0&amp;id=33d18204e8&amp;e=7b63eee6f1\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/californiansforequalrights.us10.list-manage.com\/track\/click?u%3Db78c84756813bc7a3a38500a0%26id%3D33d18204e8%26e%3D7b63eee6f1&amp;source=gmail&amp;ust=1612557938142000&amp;usg=AFQjCNFSYghx6HqTUiL_5EccUthCL0TRRg\">the Yale lawsuit<\/a>\u00a0was filed by the DOJ under the previous administration and disclosed unequivocal evidence of Yale\u2019s racial discrimination against Asian-American and white applicants. While receiving $600 million in federal funding annually, Yale has used racial balancing,\u00a0<em>de facto<\/em>\u00a0quotas, stereotypes and higher standards to discriminate against applicants from the two \u201coverrepresented\u201d groups. Specifically, race was used in an outcome-determinative manner to the extent that the admissions rate of the two groups were only one-eighth and one-fourth of the rate of black and Latino students,\u00a0<em>ceteris paribus<\/em>.<\/p>\n<p>In today\u2019s dismissal of the timely lawsuit, DOJ did not provide any reason for its hasty decision, nor did it dispute findings of discrimination in the legal challenge. In other words, DOJ simply recalled a rightfully filed case to accommodate its ideological agenda of equal outcomes and racial preferences. This is a dangerous move that will embolden various prestigious colleges and universities to violate Title VI of the 1964 Civil Rights Act and engage in illegal, immoral and counterproductive racial balancing. Moreover, this change from supporting equal treatment of all students regardless of race or ethnicity to promoting race-based considerations will exacerbate the endemic attack on the merit-based principle, which is supported by\u00a0<a href=\"https:\/\/californiansforequalrights.us10.list-manage.com\/track\/click?u=b78c84756813bc7a3a38500a0&amp;id=396de92345&amp;e=7b63eee6f1\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/californiansforequalrights.us10.list-manage.com\/track\/click?u%3Db78c84756813bc7a3a38500a0%26id%3D396de92345%26e%3D7b63eee6f1&amp;source=gmail&amp;ust=1612557938142000&amp;usg=AFQjCNGu1C3CxDWF-m9O4TNfPSYYAEMusg\">over 70% of Americans<\/a>.<\/p>\n<p>Dr. Gail Heriot, Vice President of CFER commented: \u201cThere was a time DOJ stood up for equal treatment under the law.\u00a0 Alas, that time has passed.\u201d<\/p>\n<p>\u201cInstead of embracing our constitutional principle of equal protection of the laws and the non-discrimination principle, DOJ is stooping down to entertain racial identity politics. CFER condemns its politicized decision to drop the Yale lawsuit.
