On it was $37,500 paid to\u00a0<a href=\"https:\/\/rabengroup.com\/about\/\">The Raben Group<\/a>, a Washington DC based Lobbyist Firm. In fact, we were supposed to receive all the emails between Superintendent Marten and The Raben Group through public records release tomorrow. <a href=\"https:\/\/drive.google.com\/file\/d\/1X6USAD-rHEHjT1JIRf5AfrG-YQkSsdDP\/view?usp=sharing\">We\u2019ve been waiting 10 weeks<\/a>.<\/p>\n<\/div>\n<\/div>\n<p>Just days prior to the nomination of Superintendent Marten to Deputy Secretary of Education, San Diego Unified told us\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/1c0pk_ortqhO-Q4Aj-YA6_aBTKYgWYqI2\/view?usp=sharing\">it will be 3 more weeks<\/a>\u2026. just about enough time to ensure Marten\u2019s confirmation. Why are they stalling? What is in the emails?<\/p>\n<p>Here\u2019s some background\u2026 As we reviewed board documents from the start of the school closures we noticed\u00a0<a href=\"http:\/\/go.boarddocs.com\/ca\/sandi\/Board.nsf\/goto?open&amp;id=BNPR3Q6C0F86\">buried in line item 42<\/a> of 44 of the April 28<sup>th<\/sup> Superintendent\u2019s Consent Agenda was an item for \u201cGovernmental Outreach Services\u201d with The Raben Group. That sounds benign enough, but it was for $150,000 so we decided to look at the contract. Oddly the contract was\u00a0<a href=\"https:\/\/go.boarddocs.com\/ca\/sandi\/Board.nsf\/files\/BNRKCP513F6E\/$file\/Raben%20Group%20Agreement%20Final.pdf\">only partially there<\/a>. It was missing Attachment A \u2013 the scope of work. We\u2019ve done a lot of reading of Board documents and this is the first we\u2019ve seen missing its Attachment A.<\/p>\n<blockquote class=\"wp-block-quote\"><p><strong>What does it say about the San Diego Unified School Board that they voted to spend $150,000 without even realizing half the contract was missing?<\/strong><\/p><\/blockquote>\n<p>How did they know what work they were approving? It\u2019s illegal for the Board to meet and discuss topics without public notice. Even 1-1 meetings with Superintendent Marten may be \u201c<a href=\"https:\/\/images.app.goo.gl\/wntf9kgD8vUumVcA9\">serial meetings<\/a>\u201d if they are trying to build consensus. If the Board didn\u2019t meet serially, then we have a Board that treats tax payer money like its personal slush fund\u2013 $150,000 isn\u2019t worth a single question or second glance? This is a perfect example of the lack of transparency and accountability at San Diego Unified.<\/p>\n<h3>Missing Attachment A: Oversight or Intentional?<\/h3>\n<p>We don\u2019t know but it definitely\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/1bLdrNgFIqi4_xJlyopVRwJ_kgzhGNwj_\/view?usp=sharing\">made us curious<\/a>.\u00a0\u00a0When we finally got\u00a0<a href=\"https:\/\/go.boarddocs.com\/ca\/sandi\/Board.nsf\/files\/BUJRTK6F8D2F\/$file\/The_Raben_Group_Agreement__PS20-1227-21_I.42._Fully%20Executed.pdf\">a copy of it<\/a>. Here is what the scope says:<\/p>\n<p>Such services shall include:<\/p>\n<ul>\n<li>Meet with District leadership to develop a comprehensive government relations and advocacy strategy that will support the District\u2019s key priorities;<\/li>\n<li>Create and execute a tactical plan to significantly increase education funding for states and school districts in upcoming potential stimulus packages, and other funding vehicles;<\/li>\n<li>Provide the District with a tailored suite of federal government relations and advocacy services to support and advance the policy and fiscal interests of the District;<\/li>\n<li><strong><em>Engage in direct federal lobbying of key Members of Congress, including Members of the relevant committees of jurisdiction, Members of both the California and San Diego delegations, and congressional leadership;<\/em><\/strong><\/li>\n<li>Strengthen relationships between District officials and the California and San Diego delegations;<\/li>\n<li><strong><em>Identify and build relationships with stakeholder partners in the education, disability, business, family engagement, and civil rights communities to help the District build consensus, maximize resources, identify creative advocacy opportunities, and raise the District\u2019s profile as a leader;<\/em><\/strong><\/li>\n<li>Strengthen partnerships with Los Angeles Unified School District, and other large urban school districts, where beneficial.<\/li>\n<\/ul>\n<div class=\"wp-block-media-text alignwide has-media-on-the-right is-stacked-on-mobile\">\n<figure class=\"wp-block-media-text__media\"><img decoding=\"async\" class=\"wp-image-712 size-full\" src=\"https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png?w=720\" sizes=\"(max-width: 720px) 100vw, 720px\" srcset=\"https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png 720w, https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png?w=150 150w, https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png?w=300 300w\" alt=\"\" data-attachment-id=\"712\" data-permalink=\"https:\/\/opensdusd.com\/slide1-10\/\" data-orig-file=\"https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png\" data-orig-size=\"720,540\" data-comments-opened=\"0\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"slide1-10\" data-image-description=\"\" data-medium-file=\"https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png?w=300\" data-large-file=\"https:\/\/opensdusd.files.wordpress.com\/2021\/01\/slide1-10.png?w=720\" \/><\/figure>\n<div class=\"wp-block-media-text__content\">\n<p class=\"has-medium-font-size\">San Diego Unified entered into an agreement with the Raben Group to raise the District\u2019s profile as a leader and next thing we know Superintendent Marten is being nominated to the Deputy Education Secretary Post.<\/p>\n<\/div>\n<\/div>\n<p><strong>But the most troubling of all of this\u2026 it was paid for with Coronavirus Relief Funding!\u00a0<\/strong><\/p>\n<p>While we\u2019re waiting for these emails, it\u2019s time the public gets a look at what San Diego Unified is spending on lobbyists.<\/p>\n<h2 class=\"has-text-align-center\" style=\"text-align: center;\">$370,000<\/h2>\n<p>San Diego Unified\u00a0<a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/summary?cycle=2020&amp;id=D000072312\">spent $80,000 with The Raben Group<\/a> between\u00a0<a href=\"https:\/\/lda.senate.gov\/filings\/public\/filing\/c53cb67b-25a0-4438-8c6c-519718bea117\/print\/\">April 1<\/a> and\u00a0<a href=\"https:\/\/lda.senate.gov\/filings\/public\/filing\/7a027376-a8a7-486d-8ba3-985df0dbe0be\/print\/\">Sept 30<\/a>, which is the last reporting period filed.\u00a0\u00a0The Q4 report should be released shortly. Will it be another 40k? The contract in full was $150k by Dec 31<sup>st<\/sup>.<\/p>\n<p>The last time San Diego Unified spent money on federal lobbyists was more than 20 years ago, and even then\u00a0<a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/summary?cycle=2000&amp;id=D000072312\">it was only $45,000<\/a>.<\/p>\n<p>At a State level, they have a lobbyist on staff,\u00a0<a href=\"http:\/\/cal-access.sos.ca.gov\/Lobbying\/Employers\/Detail.aspx?id=1146609&amp;session=2019&amp;view=general\">Enrique Ruacho<\/a>, and they\u2019ve also used\u00a0<a href=\"https:\/\/www.sscal.com\/\">School Services of California<\/a>. In the last year and a half San Diego Unified has\u00a0<a href=\"http:\/\/cal-access.sos.ca.gov\/Lobbying\/Employers\/Detail.aspx?id=1146609&amp;session=2019&amp;view=activity\">spent about $220,000<\/a> on these efforts.<\/p>\n<p>You can see the bills they lobbied for\u00a0<a href=\"http:\/\/cal-access.sos.ca.gov\/Lobbying\/Employers\/Detail.aspx?id=1146609&amp;session=2019&amp;view=activity\">here<\/a>.\u00a0\u00a0We especially want to point out that AB 1835 is not on the list. AB 1835 would have required\u00a0<a href=\"https:\/\/assets.documentcloud.org\/documents\/7208874\/LCFF-AB1835-BigSupport-Let.pdf\">more fiscal transparency<\/a>. It was written after a state audit found San Diego Unified and other Districts were underspending extra money they received earmarked to help high needs students. Unspent money rolls into the general fund the following year where it can be spent on anything. The\u00a0<a href=\"https:\/\/www.bsa.ca.gov\/reports\/2019-101\/auditresults.html\">Audit found San Diego Unified underspent by $3.5 million<\/a>.<\/p>\n<blockquote class=\"wp-block-quote\"><p><strong>SDUSD underspends money meant for vulnerable students and then blames stagnant student progress on lack of funding\u2026<\/strong><\/p><\/blockquote>\n<p>Maybe if the district actually started spending some of the funding on students they wouldn\u2019t need to ask for more. Outside of lobbyists, most of the CARES Act funding has been diverted toward salaries. We\u2019ll have that information in a later blog post because we are still compiling it. When we requested more documentation the district told us that <em><strong>\u201cGiven recent changes to deadlines, expenses may be moved out of this resource [payroll] to support items like COVID testing instead.\u201d<\/strong><\/em><\/p>\n<p>We wonder if they will do the same with the Raben Group Invoices, which clearly violate the CARES Act Fiscal Assurances.<\/p>\n<p>Isn\u2019t that convenient? Just move the money from pot to pot until the budget is balanced.
