{"id":4726,"date":"2020-11-26T10:30:57","date_gmt":"2020-11-26T17:30:57","guid":{"rendered":"https:\/\/sandiegonewsdesk.com\/?p=4726"},"modified":"2020-11-27T10:20:35","modified_gmt":"2020-11-27T17:20:35","slug":"judge-denies-request-from-restaurant-to-restart-indoor-dining","status":"publish","type":"post","link":"https:\/\/sandiegonewsdesk.com\/?p=4726","title":{"rendered":"Judge Denies Request From Restaurants to Restart Indoor Dining"},"content":{"rendered":"<p><em><span style=\"font-weight: 400;\">Written by Nicholas Vetrisek<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">A judge denied a request from 4 San Diego businesses seeking to restart indoor operations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The businesses, <\/span><span style=\"font-weight: 400;\">Cowboy Star Restaurant and Butcher Shop, Home &amp; Away Encinitas, Fit Athletic Club, and Bear Republic, sought a temporary restraining order on the ban on indoor operations, claiming that the majority of cases don\u2019t stem from the businesses impacted by the ban, such as restaurants and gyms.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">San Diego Superior Court Judge Kenneth J. Medel heard arguments Friday on the lawsuit, and while he agreed that the restrictions have severely impacted businesses, he argued that reopening would not be worth the risk of spreading COVID-19.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In his ruling, Medel wrote, \u201cIn the court\u2019s mind, the impact on public health of dismantling a portion of the state\u2019s COVID-19 response designed to reduce community spread outweighs the economic harm to plaintiffs at least pending further examination of these issues in any upcoming hearing on a preliminary injunction.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Decisions like this are destroying the economy in San Diego. The lasting impact of a decimated small business community will be far greater than that of COVID-19. Hundreds of businesses are closing and while many more are struggling to stay afloat.
