Instead, the Senate passed AB 323 that will only give newspapers another year of regulatory relief from the costly mandates of <a href=\"https:\/\/cssrc.us12.list-manage.com\/track\/click?u=034f5afcce53e5baa49c66e86&amp;id=ddd2b05a2a&amp;e=54d12ef701\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/cssrc.us12.list-manage.com\/track\/click?u%3D034f5afcce53e5baa49c66e86%26id%3Dddd2b05a2a%26e%3D54d12ef701&amp;source=gmail&amp;ust=1599371902886000&amp;usg=AFQjCNFevinGuno1fNX2uPJDccSq191YpQ\">AB 5<\/a> (Gonzalez).<\/p>\n<p><strong>\u201cIt is unfortunate that the majority party rejected my amendment to help community newspapers for the long-term,\u201d <\/strong>said Senator Bates<strong>. \u201cInstead, we had to settle for a short-term band-aid to cover the economic wounds created by AB 5. While AB 323 is a step in the right direction, the fact remains that we need a permanent fix to save local journalism.\u201d<\/strong><\/p>\n<p>AB 5, which took effect on January 1, 2020, requires most \u201cindependent contractors\u201d to be reclassified as employees. In recognition of the role newspapers play in informing the people, the Legislature granted newspapers a one-year exemption to AB 5 for newspaper carriers that expires at the end of this year. Unless an extension or permanent fix is passed, news operations will be forced to make deep cuts to both print and digital community coverage and offerings in order to survive. Some will close their doors, leaving many communities with no local news source.<\/p>\n<p>AB 323, which the Senate passed without Senator Bates\u2019 amendment, will extend California newspapers\u2019 exemption from AB 5 until January 1, 2022. Out of a spirit of bipartisanship, Senator Bates co-authored AB 323, but felt the bill could have gone further by permanently exempting newspapers from AB 5.<\/p>\n<p>Senator Bates\u2019 proposed amendment can be read here. Bates\u2019 amendment to AB 323.<\/p>\n<p>Earlier this year, Senator Bates authored <a href=\"https:\/\/cssrc.us12.list-manage.com\/track\/click?u=034f5afcce53e5baa49c66e86&amp;id=a9ebf642b9&amp;e=54d12ef701\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/cssrc.us12.list-manage.com\/track\/click?u%3D034f5afcce53e5baa49c66e86%26id%3Da9ebf642b9%26e%3D54d12ef701&amp;source=gmail&amp;ust=1599371902886000&amp;usg=AFQjCNHzRJZnk2CwBDEAzqSPWqE3c4rFuQ\">Senate Bill 867<\/a> that would have created a permanent exemption for newspaper distributors and carriers from AB 5\u2019s provisions. She also authored <a href=\"https:\/\/cssrc.us12.list-manage.com\/track\/click?u=034f5afcce53e5baa49c66e86&amp;id=db376984ec&amp;e=54d12ef701\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/cssrc.us12.list-manage.com\/track\/click?u%3D034f5afcce53e5baa49c66e86%26id%3Ddb376984ec%26e%3D54d12ef701&amp;source=gmail&amp;ust=1599371902886000&amp;usg=AFQjCNFv3jbiWbZyH8pUlmLEsPil9w3miQ\">Senate Bill 868<\/a> that would have created a permanent AB 5 exemption for freelance journalists.<\/p>\n<p>Due to the Legislature\u2019s focus on addressing the COVID-19 pandemic, SB 867 and 868 were not taken up this year. Senator Bates plans on introducing similar legislation next year.<\/p>\n<p>She also co-authored two other AB 5 relief bills (<a href=\"https:\/\/cssrc.us12.list-manage.com\/track\/click?u=034f5afcce53e5baa49c66e86&amp;id=9048f048f9&amp;e=54d12ef701\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/cssrc.us12.list-manage.com\/track\/click?u%3D034f5afcce53e5baa49c66e86%26id%3D9048f048f9%26e%3D54d12ef701&amp;source=gmail&amp;ust=1599371902886000&amp;usg=AFQjCNFns_z7E6ph85HTlsYpZE0_Nw7VUQ\">SB 806<\/a> Grove and <a href=\"https:\/\/cssrc.us12.list-manage.com\/track\/click?u=034f5afcce53e5baa49c66e86&amp;id=dd4502e855&amp;e=54d12ef701\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/cssrc.us12.list-manage.com\/track\/click?u%3D034f5afcce53e5baa49c66e86%26id%3Ddd4502e855%26e%3D54d12ef701&amp;source=gmail&amp;ust=1599371902886000&amp;usg=AFQjCNFGgAbvqn-JAn_tgm6Vzz70hBp0sA\">SB 990<\/a>Moorlach) this year that were rejected on partisan votes in the Senate Labor Committee. SB 806 would have allowed any industry, profession, or business that had legally utilized independent contractor relationships prior to the Dynamex court decision and AB 5 to continue to do so.
