{"id":2375,"date":"2020-02-06T12:00:28","date_gmt":"2020-02-06T19:00:28","guid":{"rendered":"https:\/\/sandiegonewsdesk.com\/?p=2375"},"modified":"2020-02-06T14:43:22","modified_gmt":"2020-02-06T21:43:22","slug":"republican-leaders-fighting-to-repeal-ab-5","status":"publish","type":"post","link":"https:\/\/sandiegonewsdesk.com\/?p=2375","title":{"rendered":"Republican Leaders Fighting to Repeal AB 5"},"content":{"rendered":"<p><em><span style=\"font-weight: 400;\">Written by Michael Palomba<\/span><\/em><\/p>\n<p><span style=\"font-weight: 400;\">The \u201c<\/span><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201920200ACA19\"><span style=\"font-weight: 400;\">Right to Earn a Living Act<\/span><\/a><span style=\"font-weight: 400;\">,\u201d introduced by Assembly Members Kevin Kiley and Melissa Melendez and co-authored by several other Republicans, would overturn <\/span><a href=\"https:\/\/sandiegonewsdesk.com\/2020\/01\/ab-5-is-ruining-lives-not-that-assemblywoman-lorena-gonzalez-cares\/\"><span style=\"font-weight: 400;\">Assembly Bill 5<\/span><\/a><span style=\"font-weight: 400;\"> to protect the gig economy and workers&#8217; rights while preventing employment discrimination.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\u201cState Assembly members Kevin Kiley and Melissa Melendez are the first California lawmakers to try to do something about California\u2019s awful new law, AB5.\u201d MM<a href=\"https:\/\/t.co\/PUzSGZZ29s\">https:\/\/t.co\/PUzSGZZ29s<\/a><\/p>\n<p>&mdash; Senator Melissa Melendez (@senatormelendez) <a href=\"https:\/\/twitter.com\/senatormelendez\/status\/1224538394392293376?ref_src=twsrc%5Etfw\">February 4, 2020<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">AB 5, authored by San Diego Assemblywoman Lorena Gonzalez, requires independent contractors to be reclassified as typical employees. This makes make them eligible for things like overtime pay and a minimum hourly wage, but removes a lot of flexibility and perks that come with being an independent contractor.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the most heavily affected industries is ride-sharing\/food delivery. This includes companies like Uber, Lyft, Postmates, Doordash, and many others. <\/span><span style=\"font-weight: 400;\">Drivers for these companies are currently classified as independent contractors. But under AB 5, they are required to be classified as employees, which drastically changes how these people can work.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, being eligible for overtime pay likely means that companies will have to limit the amount of time drivers can work. Previously, there were no limits and drivers were free to work as much or as little as they pleased. AB 5 also means that companies may need to hold drivers to a typical work schedule, removing the flexibility that allowed so many drivers to work in the first place.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Uber, Lyft, and Postmates have <\/span><a href=\"https:\/\/www.npr.org\/2020\/01\/04\/793142903\/as-california-tries-to-make-contract-workers-employees-industries-push-back\"><span style=\"font-weight: 400;\">refused to comply<\/span><\/a><span style=\"font-weight: 400;\"> with the new law and have pledged tens of millions of dollars to fight it in court.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It&#8217;s important to note that no one is forced to be an independent contractor. All AB 5 does is remove an individual&#8217;s personal freedom to choose how and when they want to utilize their labor. Government <\/span><a href=\"https:\/\/sandiegonewsdesk.com\/2020\/01\/san-diego-city-councils-electric-scooter-ban-shows-misplaced-priorities\/\">limiting individual liberty<\/a><span style=\"font-weight: 400;\"> is something that is becoming more and more common in San Diego.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">State Senator Brian Jones also made a statement regarding the Act: \u201cHardworking Californians should have the basic right to decide if they want to be an independent contractor or in a traditional employer-employee arrangement.
