It may sound like a stretch at first glance, given all of the incredibly terrible legislation passed by California Democrats, but AB 5 really is <em>that<\/em> bad.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The bill will effectively end the &#8220;gig economy&#8221; <\/span><span style=\"font-weight: 400;\">and creates a draconian system for allowing freelance workers. There are three major requirements that each independent contractor must adhere to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A) Is free from the control and direction of the hirer in connection with the performance of the work, both under the contract for the performance of such work and in fact;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">B) Performs work that is outside the usual course of the hiring entity\u2019s business; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">C) Is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed for the hiring entity.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Under <a href=\"https:\/\/timesofsandiego.com\/opinion\/2019\/10\/20\/california-will-soon-learn-assembly-bill-5-was-a-historic-mistake\/\">Part B<\/a>, \u201cJanitors could work as independent contractors only when they have contracts with companies not in the business of cleaning. Or a rideshare driver could work under a contract with Uber or Lyft only if those companies were primarily in the business of, say, selling vacuum cleaners.\u201d<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"\" src=\"https:\/\/sandiegonewsdesk.com\/wp-content\/uploads\/2019\/11\/Corrupt.jpg\" width=\"292\" height=\"175\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Naturally, Governor Gavin Newsom, in his infinite wisdom, chimed in by saying that the next step<\/span><span style=\"font-weight: 400;\"> \u201cis creating pathways for <\/span><a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2019\/09\/AB-5-Signing-Statement-2019.pdf\"><span style=\"font-weight: 400;\">more workers to form a union<\/span><\/a><span style=\"font-weight: 400;\">, collectively bargain to earn more, and have a stronger voice at work.\u201d Because nothing says worker\u2019s rights like forcing them to join collectivist unions and using government power to literally put them out of work otherwise.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Once again, the Democratic hacks in Sacramento have decided to punish hard-working people simply trying to earn a living in order to pander to special interests\u2014this time being the labor union crooks that bankrolled their campaigns. We&#8217;re looking at you, Lorena Gonzalez.
