San Diego, CA – The\u202f<\/span>Dhillon Law Group<\/span><\/a>, in conjunction with the\u202f<\/span>Center for American Liberty<\/span><\/a>, has issued a legal response on behalf of Palomar Health District Director Laurie Edwards-Tate after she was physically attacked at a Palomar Health Board of Directors meeting.\u202f<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

Background:<\/span><\/b>\u202f<\/span>Director Laurie Edwards-Tate<\/span><\/a>\u202f<\/span><\/a>responded to the District\u2019s improper use of Board policy to try to restrict her First Amendment rights. The Board continues its efforts to prevent Board members from relaying concerns involving the District\u2019s activities to constituents.\u202f<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

This comes after hospital counsel contacted Director Edwards-Tate recommending she be investigated for her public comments to her constituents regarding the\u202f<\/span>Palomar Health<\/span><\/a>\u202fadministration\u2019s change to its\u202f<\/span>website access controls<\/span><\/a>\u202fthat were not \u201ccoordinated\u201d with the hospital\u2019s legal counsel and media relations team.\u202f<\/span>\u00a0<\/span><\/p>\n

The Board argues\u202fthat its members are\u202fprohibited from conveying a message\u202fthat might reflect poorly on the District out of a \u201cduty of loyalty\u201d. Ms. Edwards-Tate argues that her capacity as an elected official is to serve her constituents by making them aware of any concerns\u202fregarding their tax dollars. To add, Directors\u2019 priority obligation under state law is to benefit public health by keeping constituents aware of concerning\u202fpolicies. \u202f<\/span>\u00a0<\/span><\/p>\n

On November 13, 2023, Director Laura Barry physically assaulted Director Edwards-Tate while calling her profanities at a Board meeting. The meeting had to be temporarily adjourned while Barry was escorted out of the room for Director Edwards-Tate\u2019s safety.\u202f<\/span>\u00a0<\/span><\/p>\n

Quotes:<\/span><\/b>\u202f\u201cThe First Amendment guarantees elected officials may freely communicate with their constituents regarding matters of public concern,\u201d said Dhillon Law Group Counsel Karin Sweigart. \u201cThe District’s continued efforts to prevent Directors from telling constituents about what is going on in the District should be of concern to the whole community.\u201d\u202f<\/span>\u00a0<\/span><\/p>\n

\u201cI never would have imagined that I would be assaulted by a fellow member of the Board because of a dissenting point of view. It is frightening, unthinkable, and now I am concerned for my safety at future Board meetings,\u201d\u202fsaid Laurie Edwards-Tate.\u202f<\/span>\u00a0<\/span><\/p>\n
