San Diego, CA – The Dhillon Law Group<\/span>, in conjunction with the <\/span>Center for American Liberty<\/span>, has\u00a0 filed a legal complaint against Palomar Health District due to First Amendment violations. <\/span>Director Laurie Edwards-Tate <\/span>is asking the court for a declaration that the Board\u2019s policies\u00a0 violate the First Amendment, and an injunction preventing the district from sanctioning her\u00a0 speech.\u00a0<\/span><\/p>\n

Background<\/b>: <\/span>In <\/span>August 2023, the <\/span>Palomar Health<\/span> administration changed its <\/span>website access<\/span> controls<\/span>. Before being able to view website content, a user has to agree to terms of use that\u00a0 waive privacy rights, waive the right to participate in a class action lawsuit, and agree to\u00a0 arbitration.\u00a0<\/span><\/p>\n

Director Edwards-Tate told a local news reporter in a personal capacity that she had concerns <\/span>\u00a0<\/span>about the terms of use. Specifically, stating that they inappropriately restricted public access to <\/span>\u00a0<\/span>the Palomar Health website.<\/span>\u00a0<\/span><\/p>\n

Ms. Edwards-Tate is a public official who obtains rights under the First Amendment and <\/span>\u00a0<\/span>California Constitution to convey these concerns to her constituents. Ms. Edwards-Tate argues <\/span>\u00a0<\/span>that she has a moral obligation as an elected official to serve her constituents by making them <\/span>\u00a0<\/span>aware of her concerns about what is being done with their tax dollars.<\/span>\u00a0<\/span><\/p>\n

This expressed opinion was contrary to hospital administration\u2019s desired messaging. <\/span>\u00a0<\/span>Subsequently, counsel for the hospital emailed Director Edwards-Tate recommending she be <\/span>\u00a0<\/span>investigated for her public comments to her constituents that were not \u201ccoordinated\u201d with the <\/span>\u00a0<\/span>hospital\u2019s legal counsel and media relations team.<\/span>\u00a0<\/span><\/p>\n

Quotes:<\/b> \u201cThe district\u2019s position here flies in the face of the First Amendment. They are trying to <\/span>\u00a0<\/span>sanction an elected official for telling the people she represents about a policy she disagrees <\/span>\u00a0<\/span>with,\u201d said Dhillon Law Group Counsel Karin Sweigart. \u201cIt is hard to think of a more blatant <\/span>\u00a0<\/span>infringement on First Amendment speech than the government telling a legislator they cannot<\/span> tell their constituents they think a government policy is a bad one.\u201d<\/span>\u00a0<\/span><\/p>\n

\u201cRepresenting my constituents is a responsibility I take seriously,\u201d said Laurie Edwards-Tate. \u201cIf\u00a0 I see something happening in the district and there is a concern about it, I have both the right\u00a0<\/span><\/p>\n

and the responsibility to let them know. Yet, for doing that, the district is threatening to\u00a0 sanction me.\u201d\u00a0<\/span><\/p>\n
